Dustin’s practice focuses on environmental and land use litigation, and he has specialized experience with climate change, permitting, and environmental review issues in the Pacific Northwest. As a member of Marten Law Group’s Climate Change and Sustainability Practice Group, he has provided clients with strategic advice on the opportunities and liabilities associated with federal, state, and local efforts to mitigate greenhouse gas emissions. A recognized authority on the rapidly evolving legal landscape of climate change, Dustin provides expert commentary on global warming litigation, legislation, and regulation for Lexis Nexis.

Dustin has represented clients in a broad range of environmental litigation matters, including successfully defending challenges to energy infrastructure projects and negotiating settlements in complex hazardous waste cleanup matters. He has appeared before the Eighth Circuit Court of Appeals, federal district court, and the Washington State Court of Appeals. In addition to his litigation practice, Dustin has managed environmental due diligence disclosures for mergers involving industrial manufacturing facilities, and provided regulatory advice on environmental liabilities related to property transactions.

Dustin earned his Juris Doctor, summa cum laude, from Seattle University School of Law and his Bachelor of Arts, magna cum laude, from Western Washington University. He was a full-time extern to the Honorable Thomas Zilly, U.S. District Court for the Western District of Washington.

Representative Experience Includes:

  • Successfully defended a public utility district in a SEPA lawsuit involving challenges to a power transmission line project in Eastern Washington, including litigation before the Washington Court of Appeals. Gebbers v. Okanogan County Public Utility District, 144 Wash. App. 371 (2008).
  • Advised regional trade association on emerging national and local climate change initiatives impacting commercial and residential real estate markets in preparation for 2009 legislative session.
  • Represented clients in complex, multi-party CERCLA litigation involving private party cost allocation and EPA cost recovery efforts. Litigated issues before the U.S. District Court for the Western District of Missouri and the Eighth Circuit Court of Appeals, and successfully negotiated CERCLA Ability-to-Pay settlement.
  • Managed environmental due diligence for fourteen PVC manufacturing facilities as part of a successful $418 million merger.
  • Successfully defended developer in a Clean Water Act citizens suit involving alleged wetland fills.
