Permitting & Environmental Review Practice
Lawyers at Marten Law Group assist clients to obtain all the permits and approvals they need to operate their business, to construct new facilities, and to make modifications to existing equipment. We advise clients on compliance and permit issues relating to state and federal regulations involving water, air, hazardous waste, endangered species and other environmental issues.
We regularly work with technical consultants and regulatory agencies to develop successful permit strategies to allow client projects to move forward without unnecessary delays. If required, we defend project approvals and permit decisions and represent clients in challenges to federal and state regulations. When necessary we defend our clients in enforcement litigation, regulatory enforcement actions, and citizen suits.
Experience:
(NEPA, SEPA, CEQA) • Shoreline Management Act • Growth Management Act • Historic Preservation • Endangered Species Act • Solid Waste Management Permits • Wetlands Permitting • Hydraulics Permits • Dredge and Fill Permitting • Resource Development and Regulation Planning
Representative Matters:
- A client needed to permit a large electrical project in one of the most environmentally sensitive areas in the State of Washington. We assisted in the preparation of the environmental impact statement (“EIS”), including helping prepare responses to hundreds of public comments. Following publication of the EIS and selection of the final project, we successfully defended the EIS in court, along with helping the client to develop a strategy to obtain the necessary permits, and acquire the necessary rights of way to get the project built.
- Marten Law Group helped a prominent Washington homebuilder maintain compliance with state and federal stormwater pollution control laws and revised their real estate contracts to appropriately allocate stormwater pollution control risk.
- A Marten Law Group lawyer represented the new owner of a brewery in Tumwater, Washington in renegotiation of its contracts with local sewage treatment authority and City of Tumwater and advised on land use and environmental permitting for proposed expansion of the brewery.
- Our attorneys assisted a client in obtaining critical revisions to Washington state incinerator rules that allowed client to comply with regulations that were otherwise impossible to comply with. We convinced the EPA that the revisions were not less stringent than the previous rule, so that the revisions could be incorporated into the federally approved State Implemenation Plan and become federally enforceable.
- Marten Law Group assisted a municipal power company to obtain emergency permits for additional generators on an expedited basis during energy shortage.
