Hands-On Experience Responding to Government Investigations & Managing Multiforum Risks
The Marten team includes a former First Assistant Attorney General of Louisiana, the U.S. Environmental Protection Agency’s former chief oversight lawyer in the Obama Administration, and U.S. EPA’s former top eDiscovery lawyer across the 15,000-person agency. Collectively, our first-chair records span hundreds of government investigations and related internal audits to identify compliance risks. We now represent businesses and individuals responding to civil enforcement actions by state and federal regulatory agencies, compliance and white collar investigations brought by state attorneys general, and congressional oversight inquiries and investigations- be they document subpoenas, transcribed interview requests, or committee appearances at public hearings. We also help clients manage the crises that can arise in the midst of intense government scrutiny, providing the steady hand necessary to mitigate the legal, reputational, business, and political risks before they spiral out of control. This includes managing the risk of parallel investigations and follow-on civil litigation. Our public service records give us the credibility with current officials and staff to negotiate pragmatic compromises, resolving actions with minimal damage and business disruption. Where that is not possible, Marten has the ability to take the matter to trial and win.
Marten also conducts internal investigations and audits for organizations, taking the measure of internal and external allegations of wrongdoing, advising on potential proactive disclosure to authorities, and developing and implementing mature compliance assurance and training programs.
