We provide regulatory advice to clients who operate disposal facilities and companies that generate and ship their wastes to third party vendors. Our disposal facility clients include landfill operators, hazardous waste disposal and recycling companies, solid waste utilities, composters, electronic waste recycling facilities, and food recycling facilities. Among waste generators, we have represented refineries, electroplaters, airlines, aircraft maintenance companies, railroads, shipyards, food processors, manufacturers, and many other industry and public sector clients.

We assist clients in waste characterization, waste management and disposal decisions, permitting, facility expansion, closure of waste units, and other regulated activities. If necessary, we also defend clients in regulatory enforcement actions and court proceedings regarding waste disposal issues.

Resolved a class action odor complaint against a solid waste client.
Successfully limited the company’s liability, allowing it to continue to operate and helped company update its environmental management systems.
Resolved largest air quality penalty ever imposed by a local air agency for less than 10% of the amount initially sought from solid waste facility.
Worked with team of experts to establish lack of evidence to support alleged air quality violations.
Represent the country’s largest private composting company in siting new facilities.
Assisting company in obtaining 404 wetlands fill permit from the Army Corps of Engineers.
Represented corporation in a criminal enforcement action by EPA for allegedly disposing of hazardous wastes without a permit.
Our lawyers convinced the agencies that the material was not hazardous, as it was being properly recycled, and obtained authorization from the agencies to allow the refinery’s cost effective practice to continue.
Assisted computer manufacturer and software maker in evaluating product stewardship, material management, and mandatory recycling program of its products.
In the absence of federal standards, electronic recycling requirements have proliferated in local jurisdictions, imposing obligations on all electronic manufacturers tied to their retail sales.
Helped a California aircraft painting company resolve an EPA enforcement action through a Supplemental Environmental Project.
The penalty originally assessed by EPA was reduced through negotiations by over 80% and the company resolved much of the remaining penalty action through a Supplemental Environmental Project.
Resolved enforcement action against used oil recycler following industrial accident which discharged waste to sewer.
The State agreed to reduce its claim by 70% and to accept facility improvements in lieu of monetary penalties.
