Pattern Energy: First Utility-Scale Wind Project in Nevada
Marten Law has successfully represented Pattern Energy, the developer of the first utility-scale wind project in Nevada – the 150 MW Spring Valley Wind Project – in the Interior Board of Land Appeals, the U.S. District Court for Nevada, and the Ninth Circuit. Settlement negotiations began after the District Court’s decision denying a preliminary injunction, sought by challengers Center for Biological Diversity and Western Watersheds Project, was affirmed by the Ninth Circuit.
The suit was dismissed after the developer agreed to minor changes in the mitigation for the Project’s potential impacts on migrating bats. The project is under construction and slated to begin commercial operation during the summer of 2012.
