EDF Renewable Energy, Inc.: 150 MW Desert Harvest Solar

We have counseled EDF Renewable Energy, Inc. on the permitting of the Desert Harvest Solar project in Riverside County, California. The 150 megawatt solar photovoltaic project was one of seven nationally significant solar and wind energy projects expedited as part of President Obama’s 2012 "We Can't Wait" initiative. The 1,200-acre project would generate enough electricity for approximately 45,000 homes. 

We acted as land use counsel for the project through its state and federal permitting processes, focusing on NEPA, CEQA, endangered species permitting, Bureau of Land Management and Department of Interior permitting, and other regulatory matters. Department of Interior Secretary Ken Salazar approved the project’s federal permits in March 2013 after we negotiated settlement of protests filed by several national environmental NGOs. We continued to advise the client with regard to the project’s local permitting process, which reached completion in June 2014.
