Waste Management Practice
Nearly every business manages wastes at some point. Federal and state laws regulate the generation, storage, treatment, transportation, and disposal of these wastes. We assist our clients in waste characterization, waste management and disposal decisions, closure of waste units, and other regulated activities. If necessary, we also defend clients in regulatory enforcement actions and court proceedings regarding waste disposal issues.
Based on years of experience advising clients on waste management issues, Marten Law Group attorneys help clients develop creative solutions to complex problems — satisfying regulatory authorities regarding compliance and environmental protection, while allowing clients to cost effectively manage the wastes that are by-products of their business operations.
Experience:
Resource Conservation and Recovery Act (RCRA) • Solid Waste Permitting • Hazardous and Dangerous Waste Permitting • Underground Storage Tanks • Compliance Counseling • Defense of Enforcement Actions • Regulatory Development
Representative Matters:
- Marten Law Group represents one of largest food processing, mining, and manufacturing companies in the Pacific Northwest on waste disposal issues at facilities throughout the region.
- Firm lawyers represented a refinery in criminal enforcement by EPA and the Washington Department of Ecology for alleged disposal of hazardous waste without a permit. Our lawyers convinced the agencies that the material was not a hazardous waste, as it was being properly recycled. We obtained authorization from the agencies to allow the refinery's cost effective practice to continue.
- Marten Law Group is chief environmental counsel to the largest recycler in Washington state and regularly advises the company on waste management issues.
